General Terms and Conditions
The present conditions are applicable to all buying acts performed on the Horzer.com website by non-trading natural persons « members ». They govern the relations between members of the game that can or cannot purchase bonuses to progress faster in the game and on the Horzer.com website which is a free community game with no obligation to make purchases in order for its members to entertain themselves.

Warning

People under 18 can only carry out purchases on the Horzer.com website in the presence of their parents or guardian. People under 18 must have their parents' permission to make a purchase by micropayment on the website Horzer.com.

The game is an original concept based on an invented world which, by no means, reflects reality or an already existing story or concept. All elements of the game must be considered original concepts unrelated to any already existing story or concept.

Furthermore, for reasons of simplification related to the game itself, the Horzer.com website has created concepts and game actions that will never be reproduced in real life. Horzer.com declines responsibility for any accidents occurring in real life that could be wrongly linked to the reproduction of an action or advice given by a member on the Horzer.com website. Horzer.com provides its members with a space called 'Profile' (or sometimes 'Blog') of the member, for them to publish their own pictures, images and all other digital documents that the member wants to show on the website.

The member is personally responsible for these elements and acknowledges that Horzer.com has only a host function and that the member must check the legality of the documents displayed for the other game members. The members are fully responsible for their Blog or Profile and will by no means publish pictures, images or any other digital documents of which they are not the authors. Any illegal publication of a document failing to comply with copyright laws cannot make the Horzer.com website liable.

Horzer.com reserves the right to restrict website access to a member who gave false or wrong information..

Furthermore, any member who doesn't respect the General Terms and Conditions could have their account deactivated or deleted without prior warning.

The Main Terms of the Game

The coinz' are the virtual currency in the game. They enable trade exchanges between members and they have no equivalent in real currency. The premz' are another virtual currency and enable the purchase of extra bonuses to progress faster, personalize your game, credit your account with coinz' or any other action available in the game. They can be acquired through micropayment, but their purchase is not completely necessary. They only let you progress faster in the game and enjoy new features. This means that a member can play each day entirely for free on the website Horzer.com if they want to.

The Profile (or the Blog) of the member defines the space the member can personalize as they want. This space is where they can publish all the digital documents they want. The PMs designate the private messages that can be exchanged between members.

Forums designate the forums of the game, which are places of exchange reserved for the members of the game.

Availability

It is possible that the Horzer.com website cannot be accessed 24/7. The nature of the Internet network itself and updates and maintenance may result in blocking the access to the website. The Horzer.com website is also optimized to run on specific Internet browsers. The website may include some bugs and/or malfunctions that can unfortunately affect the member’s game. The member accepts this situation inherent in all Internet websites and more particularly in a website where it is possible to play for free.

Update and maintenance

New functions will be offered to entertain members. This means that the game will be completed, modified and some parts of the game may be deleted or even totally closed. The member accepts this situation.

Intellectual Property

The Horzer.com website's content such as logos, menus, Internet pages, graphics, colors, screens, instruments, characters and design of the Internet website, diagrams, lay-outs, methods, processes, functions and modules that are part of Horzer.com are protected by copyright and all other Intellectual property rights.

The full or partial reproduction, in whatever form, of Horzer.com and/or its content is prohibited without the express written consent of the publishing company

Horzer.com has exclusive rights to authorize or forbid the full or partial reproduction, whether it's temporary or permanent, direct or indirect, in any form of Horzer.com and its content.

The members registered on Horzer.com accept that when they add content whatever their nature (visuals, texts...) they must yield the distribution rights to the Horzer.com website and all the different forms of its publication. No financial compensation may be asked in exchange for the transfer of these distribution rights.

Links to other Internet websites

Horzer.com contains hypertexts ('links') to other websites that have no connection with Horzer.com. Horzer.com does not control or supervise these kind of websites and their content. Horzer.com cannot be held responsible for the content and functioning of these websites, especially and non exclusively concerning your confidentiality and the treatment of your personal data while browsing.

We recommend the member be very careful when visiting those websites through the links on Horzer.com and to read the terms and conditions and their privacy policy carefully. We remind you that the General Terms and Conditions and the Privacy Policy of Horzer.com does not apply to websites published by third parties.

Moderation of the forums, blogs, profiles, private messages

In order to provide the highest gameplay quality for members and a safe, social network, free of any disrespect, Horzer.com reserves the right to delete, punish (by taking away reputation points), modify or suspend any account failing to comply with good morals and decency whether it be through private messages, the forums or the Profiles (or Blogs) of the members.

Horzer.com may also need to intervene on member accounts, particularly to solve issues reported by other members, to investigate possible cheating, insults or words that break the regulations and/or game rules in some way. Horzer.com may also develop automated or manual mechanisms examining the written discussions between members in order to detect specific words or expressions (insults, slander, etc).

Rules related to the use of the forums and the private inbox

Each member who posts a message in the forums or sends a Private Message must make sure that they are complying with the basic rules, particularly: respecting other players, not posting any insults, avoiding excessive abbreviations impeding comprehension, not 'flooding' which means posting several messages of the same or similar content, etc.

The moderator members are responsible for making sure these rules are respected and they have the right to intervene to close / delete a thread or report a member failing to comply with the forum rules.

Any member failing to comply with the rules specified in these General Terms and Conditions risks their account being suspended or deleted without notice.

Service use
The member is committed to not dirsupting, hindering or trying to disrupt or hinder the normal functionning of the Service and/or the interactions between members with inappropriate behavior and/or abusive use of one or more features offered by the Service.
The member is committed to complying with the rules and the instructions given by the Horzer team concerning the right use of the Service.

Compensation terms during the purchase of a code or a subscription to the Horzer Club

The purchases of premz' and the subscriptions to the Horzer Club are done through micropayment. At each purchase of premz', the member is credited with the amount of premz' they ordered and becomes at the same time a subscriber to the Horzer Club for the chosen duration. The subscription to the Horzer Club is renewed automatically with the means of payment such as credit card and Paypal. It is possible to cancel one's renewable subscription at any time via the 'My Account' page of the Horzer.com website. The automatic subscription renewal is done at the end of the planned period (outside the extra months offered) during the subscription to the Horzer Club.

The payment is done all at once, for the whole subscription length, during the member's registration to the Horzer Club.

The subscriptions made by credit card or Paypal also let you get a lower price if the member wants to refill their account with premz' by credit card, Paypal or another means of payment available to them. Refilling a premz' account for a subscriber to the Horzer Club by credit card, Paypal or the other means of payment does not allow for the extension of the length of the initial subscription to the Horzer Club.

The subscriptions to the Horzer Club are also available through other means of micropayment such as SMS (Pay By Mobile). In this case, the subscriptions are not renewed automatically. At each purchase of extra premz', a subscription period corresponding to the member's choice is added to the previous subscription period.

When the member uses one of the means of payment proposed by our contractor, they get in exchange one (or more) code(s) that they can use to credit their account with premz' by entering it in the space provided. Each code must be entered one at a time and is unique.

A premz' and a subscription to the Horzer Club have no equivalent in existing currency. No premz' nor any subscription to the Horzer Club will ever be refunded by Horzer.com, no matter what the reason. The member acknowledges and accepts this. No premz' nor any subscription to the Horzer Club will be refunded to a player requesting it, even if the player wants to close their account.

Only a technical error or an issue with a valid code may be subject to compensation in the form of the credit of premz' or the subscription on a member's account. The members must note carefully the codes they received; only they can be used as proof in case of error.

The member is committed to not ask for any refund in currency after a purchase. The only possible resort is to send a request reporting a problem during the purchase of a code in the provided form.

The subscription to the Horzer Club through Paypal or credit card is done without using any codes. When the member wants to subscribe to the Horzer Club through Paypal or credit card, their subscription period and their premz' will be directly credited after validation of the payment form edited by our partner Paypal (Ebay group). The premz' will then be credited each month for the chosen subscription length (including the offered months).

Regularization in case of refund, fraud and/or use of a flaw

The member acknowledges that their balance of coinz' and/or premz' can be modified in the context of a regularization done by Horzer.com. Whether it involves a debit or credit operation, this regularization can be justified by a refund following a bug (credit) and/or a member's fraudulent behavior (debit) and/or the deliberate or unintentional exploitation of a flaw in the Game, permitting the member to obtain coinz' and/or premz' that they should not have been able to get (debit).

Concerning a debit operation of the member's balance of coinz' and/or of premz', the member will have the chance of asking Horzer.com for details of the performed regularization, whatever the amount.

Broadly speaking, the member acknowledges that any recognized fraud and/or exploitation of an error can led to a regularization and/or sanctions including closing the member's account. Horzer.com also reserves the right to initiate legal proceedings against a member who exploited and/or spread around a way to carry out a fraud disrupting the game.

Update of the General Terms and Conditions

These General Terms and Conditions are likely to be updated regularly. Any modification, deletion or adding will be indicated to the member through their private inbox. Any member continuing to play the game after having consulted the modifications accepts the terms. Any member continuing to play the game is presupposed to having accepted the modification of these General Terms and Conditions.

Details about gifts

The Website Horzer.com can propose game contests to win virtual gifts, the rules of each of these game contests are defined at their creation by the game administrators.

Other game contests in partnership can be proposed to the members, their rules will be defined in each case.

Safety

Horzer informs the members that their passwords are kept under an encrypted form in its database. As such, no employee, contractor nor third party can know a member's password.

During discussions with members, under no circumstances will Horzer ask the member for their password. As such, the member should never give out their password to a third party, at the risk of exposing their account to fraudulent access.

Horzer disclaims all responsibility in case of fraudulent use of the member's account, whatever the damage suffered by the latter. The member is the only one responsible for the choice and the securing of their username and password. They must make sure the chosen password can't be easily guessed by a third party and to change it regularly. For this purpose, Horzer provides a function letting the member modify their password anytime once logged into the website.

It's also up to the member to make sure they don't write down their username and password for others to find.

Members' personal information, closing account

The members must give an email address to be able to play and be informed evvery day of all modifications or updates to the game.

When a member wants to close their account, their personal information is deleted from the Website database. The member is also allowed to modify, delete any information they want on request or through the management interface. Any member can close their account through their personal management interface accessed with their username or password.

It is strictly forbidden for a single player to create several accounts with different email addresses. The registration on Horzer.com is strictly limited to one per natural person.

Horzer.com cannot be held responsible for damage related to theft or use of an account by a third party. The member who wants to create a new game will need to delete their previous game before they can do this. Means are implemented by Horzer.com to avoid abuse and can result in the total deletion of fraudulent games.

An automatic system of reputation points removal is also established to ensure the game works well for everyone. Members contesting a reputation points removal may do so through the contact form and must indicate the specific conditions of the removal to try to recover their reputation points.

The member is the only one who knows their password, which is encrypted for safety reasons. They must under no circumstances reveal it to a third party. Private messages or posts in the forums asking a player for their password are forbidden and can lead to sanctions (loss of reputation points or suspension/closure of a game). Be careful and report to us the abusive messages through the system at your disposal for this matter, on the top right of each message.

The member is committed to not trying to harm the proper functioning of the service by attempting to pirate the website or to destabilize the game.

If an account is only used rarely, it may be closed without refunding the premz' that were previously purchased.

These terms apply to all the members registered on the website Horzer.com. In order to totally end their effect, the member has to delete their game through the management interface or a game deletion request through the contact form.

According to law No.78 - 17 of the 6 of January 1978 related to IT, files and liberties, modified by law No.2004-801 of the 6 of August 2004, the automatic personal data processing done from the Website Horzer.com was subject to a CNIL (the National Commission for computing and liberties) statement registered on the 26 of October 2009.

The member will be able to access the personal information related to them, rectify or delete it, or object for legitimate reasons to the communication of it to third parties by contacting the website at the following address: info AT Horzer DOT com.

Compensation from the member

If the member acts fraudulently, they are committed to compensating the website for legal costs and damages which may be related to their fraudulent use.

This fraudulent use may be related to the posting or diffusion of information not belonging to them (infringement of Intellectual property rights of a third party) or the failure to comply with one the clauses of these present General Terms and Conditions.

General clauses

The present General Terms and Conditions are governed by the French law.

If one or more specifications of the present General Terms and Conditions happen to be considered null or declared so by the application of a law, a rule or following a final decision of a competent jurisdiction; it will not invalidate the other clauses.

All the points mentioned in these General Terms and Conditions are sufficient for the member to make a choice to play the game in the best possible conditions in terms of information. The member acknowledges it by validating this present document.
